VIRHARMONIC'S END USER LICENSE AGREEMENT (EULA) 

THE VIRHARMONIC END USER LICENSE AGREEMENT GOVERNS THE USE OF VIRHARMONIC SOFTWARE, AUDIO CONTENT AND OTHER INTELLECTUAL PROPERTY PROVIDED BY VIRHARMONIC TO THE END USER. PLEASE READ THE LICENSE AGREEMENT (“LICENSE”) CAREFULLY BEFORE USING VIRHARMONIC SOFTWARE, AUDIO CONTENT AND OTHER INTELLECTUAL PROPERTY AS IT GOVERNS THE TERMS AND CONDITIONS OF YOUR USE. BY PURCHASING OR USING VIRHARMONIC SOFTWARE, AUDIO CONTENT OR OTHER INTELLECTUAL PROPERTY, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THE LICENSE. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE DO NOT PURCHASE OR USE VIRHARMONIC SOFTWARE, AUDIO CONTENT OR INTELLECTUAL PROPERTY. 

BY AGREEING TO THIS AGREEMENT YOU ALSO AGREE TO INSTALL CODEMETER WHICH IS USED FOR LICENCE MANAGEMENT BY VIRHARMONIC.S.R.O. FOR THE BOHEMIAN AND INSTANT SERIES. YOU ALSO AGREE TO OUR PRIVACY POLICY WHICH IS AVAILABLE ON OUR WEBSITE.

THE LICENSE

Purchasing a VirHarmonic Library (Software) from either virharmonic.com or one of our third party distributors, grants the ORIGINAL PURCHASER a License to use our samples and software for musical compositions. VirHarmonic retains Ownership of the Samples & Scripting.

LICENSE USE

You may use the samples for your musical compositions in standalone or mixed for personal & commercial use. The License is granted to the ORIGINAL PURCHASER ONLY unless specifically authorised by Virharmonic in writing. The ORIGINAL PURCHASER will here now be referred to as the “END USER”. The END USER is granted 5 Authorisations which permits use on up to 5 devices owned or used by the END USER. The 5 authorizations can be reset upon request via email to support@virharmonic.com with the email that you used to purchase or include the serial code in your email.

EXCLUSIONS

It is strictly forbidden to use our samples, software & scripting in the following manner:

RESELL, RETURNS & REFUNDS

The License granted is NON TRANSFERABLE and cannot be sold, shared, leased, rented, lent, redistributed, sub-licensed or given. Once the Serial is Authorised, the License is non returnable and non refundable. If the serial code has not been activated and a refund request is received, it must occur within 30 days of the initial purchase date.  All clearance Sales are final, regardless if serial has been Authorised or not.

LOST LICENCE

The License granted comes with 5 activations which can be used on machines of your choosing. If these activations are lost due to computer failure or other reasons, please contact support@virharmonic.com with the email that you used to purchase or include the serial code in your email.

LIMITATION OF LIABILITY

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL VIRHARMONIC BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE VIRHARMONIC SOFTWARE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF VIRHARMONIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. VIRHARMONIC IS IN NO WAY LIABLE FOR ANY CLAIMS ARISING FROM YOUR USE OF OUR SOFTWARE. YOU AGREE TO INDEMNIFY VIRHARMONIC FOR ALL CLAIMS RELATING TO YOUR DOWNLOADING, USE OR RECEIPT OF CONTENT THROUGH OUR WEB SOFTWARE.
